GENERAL TERMS

EXCEPT AS EXPRESSLY SET FORTH IN THIS LIMITED WARRANTY, XPLOSYS MAKES NO OTHER WARRANTIES OR CONDITIONS, EXPRESS OR IMPLIED, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. XPLOSYS EXPRESSLY DISCLAIMS ALL WARRANTIES AND CONDITIONS NOT STATED IN THIS LIMITED WARRANTY. ANY IMPLIED WARRANTIES THAT MAY BE IMPOSED BY LAW ARE LIMITED IN DURATION TO THE LIMITED WARRANTY PERIOD. SOME STATES OR COUNTRIES DO NOT ALLOW A LIMITATION ON HOW LONG AN IMPLIED WARRANTY LASTS OR THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES FOR CONSUMER PRODUCTS. IN SUCH STATES OR COUNTRIES, SOME EXCLUSIONS OR LIMITATIONS OF THIS LIMITED WARRANTY MAY NOT APPLY TO YOU. 

This Limited Warranty applies to the Xplosys branded hardware products sold by or leased from Xplosys Corporation, its worldwide subsidiaries, affiliates, authorized resellers, or country distributors (collectively referred to in this Limited Warranty as "Xplosys") with this Limited Warranty. This Limited Warranty is applicable in all countries and may be enforced in any country where Xplosys or its authorized service providers offer warranty service subject to the terms and conditions set forth in this Limited Warranty. However, warranty service availability and response times may vary from country to country and may also be subject to registration requirements in the country of purchase. 

Xplosys warrants that the Xplosys hardware product and all the internal components of the product that you have purchased or leased from Xplosys are free from defects in materials or workmanship under normal use during the Limited Warranty Period. The Limited Warranty Period starts on the date of purchase or lease from Xplosys. Your dated sales or delivery receipt, showing the date of purchase or lease of the product, is your proof of the purchase or lease date. You may be required to provide proof of purchase or lease as a condition of receiving warranty service. You are entitled to warranty service according to the terms and conditions of this document if a repair to your Xplosys branded hardware is required within the Limited Warranty Period. This Limited Warranty extends only to the original purchaser or lessee of this Xplosys branded product and is not transferable to anyone who obtains ownership of the Xplosys branded product from the original purchaser or lessee. 

Xplosys products are manufactured using new materials or new and used materials equivalent to new in performance and reliability. Spare parts may be new or equivalent to new. Spare parts are warranted to be free from defects in material or workmanship for thirty (30) days or for the remainder of the Limited Warranty Period of the Xplosys hardware product in which they are installed, whichever is longer. 

During the Limited Warranty Period, Xplosys will repair or replace the defective component parts or the hardware product. All component parts or hardware products removed under this Limited Warranty become the property of Xplosys. The replacement part or product takes on either the Limited Warranty status of the removed part or product or the thirty (30) day Limited Warranty of the spare part. In the unlikely event that your Xplosys product has a recurring failure, Xplosys, at its discretion, may elect to provide you with a replacement unit of Xplosys choosing that is at least equivalent to your Xplosys branded product in hardware performance. Xplosys reserves the right to elect, at its sole discretion, to give you a refund of your purchase price or lease payments (less interest) instead of a replacement. This is your exclusive remedy for defective products. 

YOU SHOULD MAKE PERIODIC BACKUP COPIES OF THE DATA STORED ON YOUR HARD DRIVE OR OTHER STORAGE DEVICES AS A PRECAUTION AGAINST POSSIBLE FAILURES, ALTERATION, OR LOSS OF THE DATA. BEFORE RETURNING ANY UNIT FOR SERVICE, BE SURE TO BACK UP DATA AND REMOVE ANY CONFIDENTIAL, PROPRIETARY, OR PERSONAL INFORMATION. XPLOSYS IS NOT RESPONSIBLE FOR DAMAGE TO OR LOSS OF ANY PROGRAMS, DATA, OR REMOVABLE STORAGE MEDIA. XPLOSYS IS NOT RESPONSIBLE FOR THE RESTORATION OR REINSTALLATION OF ANY PROGRAMS OR DATA OTHER THAN SOFTWARE INSTALLED BY XPLOSYS WHEN THE PRODUCT IS MANUFACTURED. 

Xplosys does not warrant that the operation of this product will be uninterrupted or error-free. Xplosys is not responsible for damage that occurs as a result of your failure to follow the instructions that came with the Xplosys branded product. 

This Limited Warranty does not apply to expendable parts. This Limited Warranty does not extend to any product from which the serial number has been removed or that has been damaged or rendered defective (a) as a result of accident, misuse, abuse, or other external causes; (b) by operation outside the usage parameters stated in the user documentation that shipped with the product; (c) by the use of parts not manufactured or sold by Xplosys; or (d) by modification or service by anyone other than Xplosys, an Xplosys authorized service provider, or your own installation of end-user replaceable Xplosys or Xplosys approved parts if available for your product in the servicing country. 

These terms and conditions constitute the complete and exclusive warranty agreement between you and Xplosys regarding the Xplosys branded product you have purchased or leased. These terms and conditions supersede any prior agreements or representations-including representations made in Xplosys sales literature or advice given to you by Xplosys or an agent or employee of Xplosys-that may have been made in connection with your purchase or lease of the Xplosys branded product. No change to the conditions of this Limited Warranty is valid unless it is made in writing and signed by an authorized representative of Xplosys.

LIMITATION OF LIABILITY

IF YOUR XPLOSYS BRANDED HARDWARE PRODUCT FAILS TO WORK AS WARRANTED ABOVE, YOUR SOLE AND EXCLUSIVE REMEDY SHALL BE REPAIR OR REPLACEMENT. XPLOSYS MAXIMUM LIABILITY UNDER THIS LIMITED WARRANTY IS EXPRESSLY LIMITED TO THE LESSER OF THE PRICE YOU HAVE PAID FOR THE PRODUCT OR THE COST OF REPAIR OR REPLACEMENT OF ANY HARDWARE COMPONENTS THAT MALFUNCTION IN CONDITIONS OF NORMAL USE. 

XPLOSYS IS NOT LIABLE FOR ANY DAMAGES CAUSED BY THE PRODUCT OR THE FAILURE OF THE PRODUCT TO PERFORM, INCLUDING ANY LOST PROFITS OR SAVINGS OR SPECIAL, INCIDENTAL, OR CONSEQUENTIAL DAMAGES. XPLOSYS IS NOT LIABLE FOR ANY CLAIM MADE BY A THIRD PARTY OR MADE BY YOU FOR A THIRD PARTY. 

THIS LIMITATION OF LIABILITY APPLIES WHETHER DAMAGES ARE SOUGHT, OR A CLAIM MADE, UNDER THIS LIMITED WARRANTY OR AS A TORT CLAIM (INCLUDING NEGLIGENCE AND STRICT PRODUCT LIABILITY), A CONTRACT CLAIM, OR ANY OTHER CLAIM. THIS LIMITATION OF LIABILITY CANNOT BE WAIVED OR AMENDED BY ANY PERSON. THIS LIMITATION OF LIABILITY WILL BE EFFECTIVE EVEN IF YOU HAVE ADVISED XPLOSYS OR AN AUTHORIZED REPRESENTATIVE OF XPLOSYS OF THE POSSIBILITY OF ANY SUCH DAMAGES. THIS LIMITATION OF LIABILITY, HOWEVER, WILL NOT APPLY TO CLAIMS FOR PERSONAL INJURY. 

THIS LIMITED WARRANTY GIVES YOU SPECIFIC LEGAL RIGHTS. YOU MAY ALSO HAVE OTHER RIGHTS THAT MAY VARY FROM STATE TO STATE OR FROM COUNTRY TO COUNTRY. YOU ARE ADVISED TO CONSULT APPLICABLE STATE OR COUNTRY LAWS FOR A FULL DETERMINATION OF YOUR RIGHTS. 

OPTIONS AND SOFTWARE

The Limited Warranty terms and conditions for Xplosys options are as indicated in the Limited Warranty applicable to Xplosys options. XPLOSYS DOES NOT WARRANTY SOFTWARE PRODUCTS, INCLUDING ANY SOFTWARE PRODUCTS OR THE OPERATING SYSTEM PREINSTALLED BY XPLOSYS. Xplosys only obligations with respect to software distributed by Xplosys under the Xplosys brand name are set forth in the applicable end-user license or program license agreement. Non-Xplosys hardware and software products are provided "AS IS." However, non-Xplosys manufacturers, suppliers, or publishers may provide their own warranties directly to you. 

SOFTWARE TECHNICAL SUPPORT

Software technical support is defined as assistance with questions and issues about the software that was either preinstalled by Xplosys on the Xplosys branded product or that was included with the Xplosys branded product at the time of your purchase or lease of the product. With the exception of Linux operating systems or other Linux software applications sold with Xplosys products, technical support for software is available for the first ninety (90) days from date of product purchase or lease.  Contact software technical support at 770-948-9394 or online at www.xplosys.com.  Your dated sales or delivery receipt, showing the date of purchase or lease of the product, is your proof of the purchase or lease date. You may be required to provide proof of purchase or lease as a condition of receiving software technical support. After the first ninety (90) days, technical support for software that was either preinstalled by Xplosys on the Xplosys branded product or included with the Xplosys branded product at the time of your purchase or lease of the product is not provided. 

Xplosys does not provide software technical support for Linux operating systems or other Linux applications. Software technical support for Linux software sold with Xplosys branded products is provided by the Linux vendor. Please refer to the Linux operating system or other Linux application support statement included with your Xplosys branded hardware product. 

WARRANTY PERIOD

All pre-assembled Xplosys branded products carry a Standard One Year Limited Warranty. Extended warranties may be offered on some products from time to time and are governed by the same rules and limitations as Xplosys Standard One Year Limited Warranty unless specifically stated in a product purchase or lease agreement. 

ON-SITE WARRANTY SERVICES

Unless an additional fee is paid and on-site maintenance is specifically stated in a product purchase or lease agreement, all warranty work will be accomplished at Xplosys (in-store) locations, the location to be determined by Xplosys. 

REPLACEMENT PARTS PROGRAM

Where available, the Xplosys Replaceable Parts program ships approved replacement parts directly to you to fulfill your warranty. This will save considerable repair time. After you contact the Xplosys Technical Support Center at 770-948-9394 or online at www.xplosys.com and it is determined that a replacement part is necessary, a replacement part can be sent directly to you. Once the part arrives, call the Xplosys Technical Support Center at 770-948-9394. A technician will assist you over the phone to ensure that the installation is quick and easy. 

OBTAINING WARRANTY SERVICES

Prior to contacting Xplosys directly for warranty services, you should use the Xplosys support services and venues made available to you at www.xplosys.com when possible.  You may initiate a warranty service request online or by calling Xplosys technical support at 770-948-9394 Monday through Friday, 10AM to 6PM EST, except holidays.

If it is determined that warranty service is required and the problem cannot be corrected by means of the Replacement Parts Program, Xplosys technical support will issue a service work order number for the repair or service.  The work order will have a valid life of thirty (30) days from the date of issue.  If the shipment is not received by Xplosys technical support within thirty (30) days, the service work order will become void.  The customer is responsible for packaging and shipping cost of the Xplosys branded product to the most appropriate Xplosys repair facility, the location to be determined by Xplosys.  All returns must be properly packaged to prevent damage and sent insured via UPS, Federal Express, or any other courier that issues a tracking number. We will not be responsible for damage caused by shipping.

Return Policy

All Sales are final and title of product passes to you upon receipt of product.  Return of product may only be made for defective products.   Defective products will be repaired or replaced at our option.  Under no circumstances may a product be returned for Full Credit.

Incompatibility Returns
If a product is not compatible, you may return the product within 30 days only for an 80% credit of the product purchase price. This credit will not include shipping or handling or rush charges.

Any other Return for any reason will be subject to a 20% restocking fee.

Shipping and Handling and Rush Charges will not be refunded under any circumstances.

Products may be returned to Xplosys Corporation for repair or replacement in the following manner: Returns to Xplosys Corporation must be made within 30 days of the invoice date. After 30 days, no returns will be allowed or accepted. Before returning any item, you must contact our Returns Department for a Return Merchandise Authorization number (RMA). No returns, of any type, will be accepted without an RMA number. The RMA number is good for only one (1) item and must match the product authorized for return. RMA numbers are valid for 10 business days and all returns must be received within 10 days of obtaining the RMA number. You are responsible for shipping costs of all returns. Laser printers, inkjet printers, fax machines, and special order items may only be returned for replacement and not for any refund. Software returns will be accepted for refund only if the product is unopened. Non-defective software that has been opened will not be accepted by Xplosys Corporation for return. Defective software may be returned for exchange with the same product only. All refunds for non-defective items exclude shipping and handling charges. Please allow 2-4 weeks for refunds to be processed and credited to your account. In order to receive a refund, your purchase must be returned with shipping pre-paid. All items must be in "as-new" condition, in original packaging and with all warranty cards, manuals and accessories. The original packing slip must be included and the RMA number visible on the package. Any discrepancies could result in a delay or full or partial forfeiture of your refund. There will be a $35.00 re-boxing fee for products not returned in the original manufacturer’s packaging. If part of a product becomes defective, the full product must be returned for credit or replacement.

All returns must be properly packaged to prevent damage and sent insured via UPS, Federal Express, or any other courier that issues a tracking number. We will not be responsible for damage caused by shipping.

Typographical Errors

In the event a product is listed at an incorrect price due to typographical error or error in pricing information received from our suppliers, Xplosys Corporation shall have the right to refuse or cancel any orders placed for product listed at the incorrect price. Xplosys Corporation shall have the right to refuse or cancel any such orders whether or not the order has been confirmed and your credit card charged. If your credit card has already been charged for the purchase and your order is canceled, Xplosys Corporation shall immediately issue a credit to your credit card account in the amount of the incorrect price.

Order Acceptance Policy

Your receipt of an electronic or other form of order confirmation does not signify our acceptance of your order, nor does it constitute confirmation of our offer to sell. Xplosys Corporation reserves the right at any time after receipt of your order to accept or decline your order for any reason. Xplosys Corporation reserves the right at any time after receipt of your order, without prior notice to you, to supply less than the quantity you ordered of any item. All orders placed over $2000.00 (U.S.) must obtain pre-approval with an acceptable method of payment, as established by our credit and fraud avoidance department. We may require additional verifications or information before accepting any order.

Payment Methods

Credit Cards - We accept major credit cards including, Visa, MasterCard and American Express. There is no surcharge for using your credit card to make purchases with Xplosys Corporation . Please be sure to provide your exact billing address and telephone number-the address and phone number your credit card bank has on file for you. For your protection, we will only ship to the billing address of your Credit Card.  Incorrect information will cause a delay in processing your order. Your credit card will be billed upon processing your order.

Money Orders, Cashier’s Checks, Company Checks, & Personal Checks - Xplosys Corporation accepts money orders, cashier’s checks, personal checks, and company checks in U.S. Dollars only. Orders are processed upon receipt of a money order or cashier’s check. For personal and company checks, please allow up to 21 banking days after receipt for clearance of funds before the order is processed. Xplosys Corporation cannot guarantee the availability of a product by the time funds clear or payment is received. We will charge a $25 fee on all returned checks.

Shipping Policy

Xplosys Corporation does not ship on Saturday or Sunday. Due to shipping restrictions we cannot deliver to P.O. Boxes. All Shipments are subject to stock availability.   We are not responsible for shipping damage.  Any damage claim must be made with the shipping company.

Shipping Rates & Terms

Standard Shipping
Estimated delivery 3 to 7 days following shipment
Hardware, Software, Electronics, and Clearance products usually ship via UPS - tracking information provided when available.

Calculating Ship Times The time it will take for you to receive your order depends on the "Manufacturing Schedule" time you choose for the product ordered plus the Shipping Time for the delivery method you select.

Total Ship Time = Manufacturing Schedule Time + Delivery Method Ship Time.
For example, if the Manufacturing Schedule is 3 to 6 days, the Delivery Method Ship Time is 1-2 Business Days, you will receive your order in 4 - 8 business days.

Choosing next day or second day air does not mean your order will be delivered in 1 or 2 days from the time you place your order online.
You will receive your order 1-2 days after the "Manufacturing Schedule" time listed for the product you selected. The "Manufacturing Schedule" time is the amount of time required to process your order through our warehouse and acquire or build the product requested.

If you choose items with different "Product Availability" times -- for example, a in-stock delivery item along with a "Backorder" or "Preorder" item, each item will ship as it becomes available. There will be no extra charge for the shipment of these items.

Note: Please keep in mind that our warehouse does not ship on weekends and we do not offer Saturday or Sunday delivery.

Sales Taxes

Xplosys Corporation shall automatically charge and withhold the applicable sales tax for orders to be delivered to states in which we have a location.  Each customer shall be solely responsible for all sales taxes, or other taxes, on orders shipped to any other state.  In the event of a partial refund, the applicable sales tax will also be refunded.

If the product is not returned to us with all of the original packaging, it will be sent back to you. All products will be tested upon receipt in our warehouse. If it is determined that the product is in working condition it will be sent back to you.

All returns must be sent via UPS, Federal Express, or any other courier that issues a tracking number.

Manufacturer's Warranty

All returns and replacements occurring after 30 days from the invoice date must be made directly with the manufacturer. Manufacturer’s warranties vary on each product. Extended warranties are available directly from select manufacturers. Manufacturer information is subject to change without notice.

Service and Support

All requests for technical service and support should be made directly to the manufacturer in accordance with their terms and conditions. Xplosys Corporation will provide on-line technical notes on most computer hardware & software products as well as to the technical support departments of the manufacturers.
